Rules of the competition “Win the smartwatch”

(further as “Rules”) effective from the 1st of September 2024.

The purpose of this document is to provide a complete and clear set of rules for the “Win a smartwatch” competition (hereinafter referred to as the “Competition”). These Rules are the only document that fully and bindingly governs the rules of the Competition as set forth on the www.loveit.sk website (including any subpages through which registration for the Competition may be made), consumer promotional materials, or as otherwise communicated. The Organiser reserves the right to unilaterally amend or supplement these Competition Rules; in such case, the Organiser shall publish the amended Competition Rules in such a way that they are publicly available, in particular on the website www.loveit.sk and its subpages through which it is possible to register for the Competition, including with an indication of the effective date of the change.

1.The Organiser
The organiser of the Competition is:
Love IT, s.r. o., with registered office: Bernolákova 1578/7, 900 31 Stupava, Slovakia, ID: 50700979 (“Love IT”) (“Organiser”).

2.Time and place of the Competition:

The Competition shall run from the 1st of September 2024 until the 16th of September 2024 (unless previously cancelled) (hereinafter referred to as the “Competition Period”).

3. Entry into the Competition:

3.1 The Competition is open to any person who meets the following conditions for participation:

3.1.1 is over 18 years of age and has full legal capacity,
3.1.2 successfully answers the survey questions and fills in the contact details published on the website www.loveit.sk or its subpages through which it is possible to register for the Competition (hereinafter referred to as the “Registration Form”) and grants us his/her explicit consent to the processing of his/her personal data for the purpose of organizing consumer competitions (after having read the terms and conditions of personal data processing via the document published by the Organiser of the Competition on this website),
3.1.3 truthfully and correctly completes the Registration Form with his/her personal data, at least to the following extent of the personal data provided:
– Name,
– Surname,
– Mobile phone number,
– E-mail address, (“Participant”).

3.2 Participation in the Competition shall commence on the date on which the cumulative fulfilment of the conditions of participation pursuant to clause 3.1 of the Rules has occurred.

3.3 Participation in the Competition is not conditional upon consent to any related advertising, marketing and promotional material being sent to you and consent to the processing of personal data for the purposes of sending advertising and promotional materials.

3.4 Participation in the Competition ends for the Participant on the date on which any of the following occurs as first:
3.4.1 The Participant becomes a Winner,
3.4.2 the Participant is disqualified from the Competition pursuant to clause 5.4 of the Rules,
3.4.3 the Competition ends or the Rules are changed so as not to allow the Participant to participate in the Competition,
3.4.4 the Participant ceases to meet the conditions for participation under clause 3.1 of the Rules,
3.4.5 any other event specified in these Rules or generally applicable law occurs which results in the termination of the Participant’s participation.

3.5 Each Participant may only enter the Competition 1 time in total.

4. Nature of the Competition, the Competition Winners and the Competition Prizes:

4.1 The winner of the Competition will be the Competition Participant who is selected by the Organiser by random draw from among all the Participants (“Competition Winner”).

4.2 By participating in the Competition, the Participant will have the opportunity to win a prize – smartwatch Garmin Venu 3 Slate/Black band (at the normal price of 448,90,- EUR) for free (hereinafter referred to as the “Prize”). The Organiser may.

4.3 The draw of the Winner will take place by the 15th of September 2024.

4.4 Winner´s name with the first letter of the surname will be published on the website https://www.loveit.sk/survey/.

4.5 The Winner of the Competition will be informed of the Prize immediately by telephone at the telephone number she/he has provided in the Registration Form. In the event that the Winner cannot be contacted by telephone, she/he will also be notified of the Prize by text message and email address. The Organiser is not responsible for the actual delivery of the sms message, nor for the availability of telecommunication services.

4.6 Participants acknowledge that the following restrictions apply to the Competition:
4.6.1 there is no legal claim to the Prize and the provision of the Prize is not enforceable in a court of law,
4.6.2 the results of the Competition are final and shall be decided solely and exclusively by the Organiser,
4.6.3 Participants may not claim any Prize other than that which has been confirmed to them by the Organiser pursuant to clause 4.2 of these Rules,
4.6.4 at the time the Prize is handed over, the Participant must comply with all of the conditions of entry under these Rules.

4.7 The handover of the Prize shall be deemed to take place on the day on which the Participant receives the Prize by the mail/courier.

4.8 The Winner’s Prize, which for any reason cannot be handed over to the Winner even within 60 calendar days from the date of the draw, will be at the discretion of the Competition Organiser.

5. Rights and Obligations of the Organizer:
5.1 The Organiser reserves the right to shorten, postpone, suspend or cancel the Competition altogether, including without giving any reason and without providing a compensation.

5.2 The Organiser shall not be liable for any damages or other claims incurred by the Entrant in connection with incorrectly given/provided or inaccurate data of the Participant and in connection with the non-application, rejection or non-receipt of the Prize. The Organiser is not responsible for any loss, non-delivery or delay in delivery of the Registration Form or for any technical problems related to participation in the Competition. The Organiser is also not responsible for the fulfillment of the tax or levy or any other obligation of the Winner of the Competition, unless otherwise provided by the relevant generally binding legal regulation.

5.3 Employees of the Organiser or any other persons close to them (as defined in the first sentence of Section 116 of the Civil Code) may not participate in the Competition. If it is proven that the Participant is such a pre-excluded person, the Organizer is entitled to decide to exclude such Participant from the Competition. The Organiser’s right to compensation is not affected.

5.4 The Organiser shall be entitled, at its sole discretion, to exclude Participant or Winner from the Competition if:
5.4.1 it finds that she/he has provided false, incomplete or misleading data or information,
5.4.2 it is a pre-qualified person as referred to in clause 5.3 of the Rules,
5.4.3 he/she is found to have acted or intended to act in breach of these Rules, attempted to obtain the Prize by fraudulent means, in breach of good morals or would in any way, even potentially, bring the Organiser into disrepute by his/her conduct,
5.4.4 in any other way violates the obligations set out in these Rules and/or generally applicable law.

5.5 In the event of any conflict between the Competition Rules or any part of them appearing on promotional materials or other materials of the Organiser and the text of these full Rules, the text of these Rules shall prevail.

6. Special provisions
6.1 The Organizer shall not reimburse any costs incurred by the Participant in connection with their participation in the Competition.

6.2 By participating in the Competition (by completing and submitting the Registration Form), the Participant agrees to the Competition Rules and undertakes to comply fully with them.

7. Privacy Policy
7.1 The Organiser is the data controller for the processing of personal data for the purpose of organising consumer competitions. Information on the terms and conditions for processing personal data in connection with participation in the Competition is set out in the document published by the Organiser at https://www.loveit.sk/ zasady-ochrany-osobnych-udajov/.
